    Child abandonment
    My wife left with my 14 yr old daughter after being caught cheating with a married man. She then went to live with her mother and father. Later she moved with her still married boyfriend oved to Florida and left my daughter with her parents (my daughters grandparents). We are in court and have been for 9 months with only one hearing for a tempory hearing. There are no restraining orders just state standing orders. Is this child abandonment?

    So much depends on the exact state law, but abandonment is normally either.
    Non payment of court orderd child support, this seems not to be the case.
    The other is normally just terms used in court to ask for a wrong to be fixed, by granting visititaion, support or other legal methods.

    I would ask, when did you first file for custody? The day she left did you file in court for custody. When she let you know or when she left state, did you file that week asking for an emergancy order to force her to either stay in state or to come back to your state ?

    These are all important issues, since they protect your rights in court.

    If you did nothing till she already moved or until she moved and filed for child support you have little legal choices at this time

    100% with FrChuck. Where are you, when did your wife leave with the child, when did you first file?

    Leaving you for a married man may be a bad moral judgment but makes no difference over leaving you for an unmarried man.

    What do the original orders say and in what state were they generated? Are you still in that state?
