Family law
I have a case plan open by cps on my 2 children right now and I will complete all my classes in December. They already returned my children to there dad when he completed his classes. I am pregnant and will have my baby around jan-25-11 and My children's fathers case plan will be closed on jan-6-11. My worker told me they would close my case as well on that date but so far she has done nothing but lie and make things worse. Is it possible for me to sign over guardianship of my unborn baby so I don't have to worry about her trying to take the baby?

If I don't put the father on the birth certificate and want to sign over guardianship of my unborn baby, can he contest it?

Yes... the birth certificate is only a piece of paper, not a title to a human child. If he is proven to be the father VIA DNA testing at his request, he can in fact put a stop to it... and request full custody himself.

Yes, he still has rights to the child. What type of guardianship were you thinking of doing ?

I just want to appoint temporary guardianship of the unborn child so cps cannot take the baby no matter what.

No you can't appoint guardianship of an unborn. You have to wait until they are born before they become a legal entity.
