    Rights over a child?
    Need legal advice - the father of my child is a alcoholic and has a drug problem, he spends money like crazy (on his bad habits) and I'am stuck there with him at his parents house because he wreaked my car and so he left me jobless and no money just staying at home taking care of my child stressing about food and formula. He drinks and drives and seems like he's is more worried about the party life instead of worrying about his child needs, he does not seem to change his ways which is starting to concern me on the fact that I do not want him in my child life if that's the way he wants to live his life, he has been to jail several times and has 2 DWI s. As a mother I want the best for my child and would love to just move out of state were I can try and give my son a better life without having to worred that the father is driving drunk with my child without me knowing ( it is expected from him it wouldn't be the first time either ) what can I do so I can't try to move out of state for the sakes of me and my child. I need a bullet proof plan because I have no family here and if I fail I would regret this for the rest of my life knowing that a irresponsible person like him has a child in his custody braking the law!

    If you are not married to him you are free to leave him at any time with your child if there is no court order for child support or visitation in place.

    I have to bring this up. Did he become an alcoholic and drug user only after you had sex with him? Courts do look at the fact that if he was such a bad person why did you have a child with him.

    But the thing you didn't tell us is whether he is the legal father or whether there are any court orders on custody. Also ANY question on law needs to include your general locale as laws vary by area.

    I would suggest trying to find a support group that can help you prepare.

    I will agree, you are not trapped if you really want to move, there are women shelters, women groups, support groups and more. Your worry about food, you live with his family, so they will let you go hungry ?
