    I was involved in a car wreck in June, I was driving my friends van..
    I was driving my friends van and rear ended someone. Her van was totaled. It is now October and for the past month I have had chronic lower back pain. I had an MRI and I have a bulging disc and no insurance. By the way I didn't want to drive her van but she couldn't go to a basketball tournament and needed me to take her child so she insisted that I drive her van. It was an older van and I did pay her $500 deductible. Back to the story so I'm in pain and I called my insurance company to file a claim and they said I had to call her insurance company they would be primary. Now she was actually buying the van from her brother so the insurance is in his name I believe. I called the adjuster on the case and let him know I had an MRI and I have a bulging disc. He emailed me a medical release form and asked me to sign and send back. I feel terrible for having to file a claim and I was at fault. I live in Texas but accident happened in Kansas which is a no fault state I believe I was told. What should I do.. I don't have insurance should I go to emergency room or get a lawyer? I had to pay for the MRI out of pocket $450.. This is going to be expensive.. Please help!

    The primary insurance is the policy of the owner of the van at the time of the accident. If the owner was the woman's brother then it's his insurance that was in effect. It's not clear from your post whether you have contacted his insurance company or not. You should do so ASAP.

    Where the van is insured, not where the accident happens decides what type of policy the person has.

    But correct you have to contact them and contact their insurance, that is the only option, I am sure they already contacted them about the loss of the van, I have no idea why you are worreid about contacting the insurance company
