    How to refile for child support?
    Hi, I won custody of my children back in 1999 and my ex was ordered to pay child support and also pay back a fee that was charged to me because she moved our son to Washington and received government aid there when we first divorced, anyway we went to court and she was ordered to pay and I have received a small amount through the help of Support Kids, however she was arrested for theft and did 2 weeks and when she was released on probation she fled back to our home town and she has avoided paying her child support. She does work but she manages to have the employer pay her cash so she doesn't get caught. Is there any way to reopen the case? I have already spent so much money trying to get her to pay it, we have 4 children together and it doesn't seem to bother her that she hasn't paid. My wife of 12 years is the one who has helped me raise them and helped me with all the necessary paper work and things. I just think it is time for her to pay her dues. Is this possible?

    What do you mean "reopen"? It seems that you need to figure some way to collect the amount already ordered and unpaid? Is that what you mean?

    If she is dodging paying child support you just present a contempt motion to the court, you don't have to reopen the case as child support matters really don't "close" as it is an ongoing matter for sometimes years.

    The case is still open. Many states have agencies that help collect support. But if she is working off the books and her income is under the table, it will be hard to collect.

    How do you know that she is working under the table? Do you have proof or is this just an accusation? If you contact the agency from the state you are in they can help you. They will contact the state she is in if it is different then yours. They can put sanctions against her and place her in jail. Also depending on the original state the order was in there may be interest involved.
