My son Violated probation, do I have the right to request a arrest report?
My sons first offense was Breaking and entering of an unoccupied home, 2nd degree felony,as well as Grand theft 3rd degree more than 300 less than 20000. This happened on 9/15/2010 He has gotten a job and worked since as well as rented a mobile home in a very nice retirement area. He was arrested for breach of peace recently and is in Sharpes custody at this time. I would like to see the arrest report and the public defenders office told me when I called that they wouldn't get records till right before court so they cannot tell me anything. They told my son that they wouldn't know anything until a few minutes before court.
I feel so helpless, this could ruin his life and I just want to help. I cannot afford a Criminal Attorney at this time. I take care of my Mother who needs 24 hr care and have for four years. I do not get paid. Please help if you can in any way. I am selling mu Indian artifact collection to help but his court is Nov 8th and I can only hope I do it in time. I am in TN he is in Fl. If your son can't tell you why he violated his probation you getting the actual records won't help. You may get a copy of the Warrant for his arrest for the violation of probation though. In the warrant will be the reasons for his probation violation. Just call up the Criminal Clerk at the Court where his case is to be heard and ask the clerk to read this to you. It is public information and you are entitled to this. He won't be getting the services of the public defender's office this time as this is post conviction matter and public defenders only do pre conviction matters.
He may not be able to live in the mobile home community as a convicted felon. Once they find this fact out he will be forced to move as no felons are allowed to live in mobile home communities in Florida or any other state. I don't know how they missed his background and let him move in the rented home. |

As for my Son, he did tell me the reason for the arrest. I would like to see the Officers Statement on the arrest report. I just want all the facts. When reading the statutes, I found I needed the facts. Thank you again |
