    Accounts emptied
    I was served with a garnishment from a prior judgement i had no clue about back from 2009 a few months ago.. i made an agreement with the guy who served me the papers to make 50 dollar a month payments until paid in full which i have made the payments.. he not only filed in the county i live in he also filed in another county.. i woke up this morning to an empty checking and savings account... i am unemployeed and have 4 children.. what can i do?

    First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

    Second, please don't type in all caps, its considered shouting and is harder for most to read.

    Did you know about the debt? Did you get your agreement to make payments in writing?

    You had a chance to get the judgment vacated when you first learned about it. That you didn't and made an agreement to pay on the debt removes that chance. So your only hope is if you can prove that he agreed to accept the $50/month.

    If you can prove that, you go to court Monday morning and ask that the writ of execution against your bank accounts be lifted on the grounds that you had a payment plan in place. If you can't prove it, then he is entitled to seize your funds.

    You made an agreement with the process server or with a representative of the company? Was anything in writing regarding this agreement?
