    Summons for credit card debt sent to wrong person?
    I had a certified letter and signed for it. It was in my name and addressed to me. When I opened it, it was a summons for court for credit card debt but the thing is.. it wasn't for me. It was for some man that lives in the same town. They mixed up the summons and sent mine to him. Is there any legal action I can take? As well as him? I have all his information that came with his summons. I am really angry that he has all my information about my credit card.. name, address, acct number, ssn.. what should I do?

    No. Court filings are a matter of public record, and chances are that he wouldn't have know you were being sued absent this mistake, although he could have known if he had bothered to look.

    How do you figure you are damaged by this person, who I assume you don't know from Adam, seeing a copy of the court filing? I doubt that you can prove any damage. What ill do you imagine this person could do with the information, if he had a mind to?

    Contact the law firm that made the mistake; scold them to your heart's content; and ask that they send you the correct paperwork. Then answer it in a timely fashion.

    Ok thank you. It was just a question. I have contacted them and I am getting my correct paperwork.
