What is generally the limit of a sentencing for the judge to even consider probation?
I was told that the judge considers probation if you get sentenced under a certain amount of time. There is some kind of cutoff for this in terms of months. I was just curious if anyone knows or has any experience on this kind of subject. I am awaiting sentencing and its looking somewhere between 18-24. First time offender. No criminal History. Aiding and Abetting. Any info is appreciated.

Well, is this in Russia, Australia, The UK, Canada, the USA?

And what State or Provence would it be.

Being we have members and posters from all 4 corners of the earth, some geographic specifics would help. I also assume you were charged as an adult and not a minor.

In the US, at least in my area, no there is no set cut off. People with many years to serve, may get probation if they have have good ties to the community, don't seem to be a threat or risk, don't have prior criminal history.

Someone with a 3 month sentence may have to serve the entire 3 months.

After that Two different people doing the same crime, before different judges may get totally different sentence, it may depend on the crowding in local jails, how that state prisons are crowded or not. And so on
