    Judgement on Home? When spouse on SSD
    Wife has a couple of judgements for CC defaults when she became ill. Can they attach the judgements to our home? With rates so low right now I would like to refinance but am afraid to start the process. Any thoughts?

    What state would this be in? Garnishment laws vary by state.

    First, ANY question on law needs to include your general locale as laws vary by area.

    Second, it is rare but not impossible that a lien can be placed on your home over unsecured debt. If such a lien was placed, it would prevent the sale of the home until the lien was satisfied. It might not, however, prevent a refinance.

    Check with the county clerk's office (they usually handle recording of deeds and liens) to see if a lien has been recorded. Then contact your lender to about the refinance.
