    Amount I can sue for in SC court
    I was given a letter from my Dr. To repair my mobility wheelchair on 6/21/2011 and my care giver delivered it to the company where the chair was gotten from. The chair was paid for by medicaid. They told me the part was ordered and would be in in a few days. We waited the few days and called and was told the part was shipped by the company COD and the lady running the business could not write a check for it. We were told the owner was in Nigeria and could not be reached. Several days later my medical supplies were to be there and was told the company they get them from would not ship them because of unpaid bills. It took us a few weeks to find someone to repair the chair and another place to get my supplies from. It is the 27th of August and I have not been out of the house, except for a stay in the hospital since June 21st. When I could not get my supplies I had to duct tape a plastic bag onto my body because I have an ostomy. Or if not in small claims court I need to find an attorney that will take my case. I am on SSI so I don't have money to pay one.

    I am not sure what "case" you want to do.

    From the sound of it, you had a very poor vender but did find another one.
    So you have not gotten your chair fixed.

    I will say this that on power and wheel chair repair, that it can take weeks to get approal to even officially order the parts, I am not sure the lady at the wheel chair was telling you the truth or not.

    What happens, there is a official form that the doctor has to file out, not just a note on his prescription pad. After that it is sent to your insurance before the parts are ordered to get approval.
    Once they get approval, then the part is ordered, It can often take 2 to 4 weeks with medicaid to get parts in to fix a chair.
    With some private insurance it can take 3 to 8 weeks and I have seen a few longer.

    Why are you not getting your ostomy supplies from the local drug store, a DME company is not normally the right place to get it from.

    Also if this power chair company does not have loaners and service people and does not have creidt accounts with their venders you need to find another company.


    It appears that you did not just to the next day to someone else ?
    I guess I have to ask why ?

    Small claims maximums depend upon which state you are in. But in any event, it is not clear what your damages, if any, would be.

    And what your ostemy connection has to do with the wheel chair is also unclear.
