    No. Not unless it was ordered by the court as an alternative. Its not a decision you can make on your own.

    What state and country would this be.

    Almost never, if the crime was minor and you are a rich millionaire and can hire dozens of attorneys, maybe, but normal people, no, but they may allow court ordered rehab instead of prison is you go to court.
