    House is not habitable can landlord still charge rent?
    We have been out of our house for 2 months. Rent was paid for the first month until the question came up, why should we be paying for somewhere we can't live. Our kitchen caught fire so they are doing construction, aspestus sealing, etc... can my landlord legally charge me full rent or any at all if the house is not at all habitable?

    Whose fault was the kitchen fire, is there a lease.

    If you caused the fire, then he can claim all damages including loss rent against you. ** but that is what your renters insaranace is for

    Your renter's insurance should be covering your living expenses while the property is fixed. If it is not being fixed on a timely basis you can send the landlord a notice that if it isn't repaired soon you will consider the lease void and you will find someplace else.
