    Violation of Felony probation
    Hello my boyfriend went to see his Probation officer yesterday and got arrested on the spot, and booked that day. We live in Virginia. We are not sure why she violated him, but he was on felony probation. And He has been out since April of this year, and it is now July. How much time will he do for this, I need to know... People are telling me all kinds of things, which is ridiculous. It is his first violation, and he is on Probation in 2 countys, so he got violated in 2 countys, just because one county violated him the other one did as well. How much time will he have to serve? I pray to god not long. I was thinking a few weeks. I need a ligit answer, that is true. Not any maybe's.

    Please don't dictate how your question will be answered unless you are speaking to an Attorney and paying for the advice.

    I don't understand why he wasn't told HOW he violated but: he could be sentenced to the sentence he would have received if he had NOT received probation; he can receive that sentence plus additional time for violating; he could get a warning.

    There is no "usual."

    My suggestion is that he find out how he violated or he's going to violate again.

    They could let him go with a warning, even so he has already been violated and has been sitting in jail yesterday? He has court tomorrow morning and his getting transferred to farifax county jails considering that is where the probation offier is, who violated him.

    A PO can throw you back in jail just for looking at him or her wrong.
    If your BF talked to his PO the way you are here, making demands no one can meet, then that may be why he doesn't know why he was violated. He really doesn't have the rights of a free man when on probation.
    You're just going to have to wait, and try not to cause trouble for him.

    You don't know me or my boyfriend so don't pass judgements A. and B I am not talking in any way I was trying to get the advice of someone who is educated on this topic which is Obviously not you,and you have made that clear. I am not causing any trouble for him, another thing you have no idea what your talking about. Nobody said he has the rights of a free man, so I don't know why your going there with me, I was wondering how much time he was looking at. Please don't reply I don't have time for this crap.     Hello c:

    I couldn't tell you how much time he's facing unless I know what he's charged with. There are simple technical violations, like missing a meeting... and there's SERIOUS violations like failing a drug test or getting new criminal charges...

    So, if it's a minor technical violation, it'll probably be no more than a few weeks... But, if it's SERIOUS, it will be LOTS longer depending on HOW serious.

    It would HELP if you find out exactly what they think he did... It's not a secret. In fact, I'm sure your boyfriend knows.. I don't know why he's not telling you, or you're not telling us.

    1. he is likely to sit in jail for a couple weeks to a month or more just waiting for the hearing

    At the hearing, it is completely up to the judge, did the judge have a good morning, did he fight with his wife, did the offender before your boyfriend curse him out and get him in a bad mood.

    At the least, he can get a good taking to and be put back on probation.

    At the most, he can serve his entire probation sentence in prison.

    Most likely it will be a warning or something in between.

    Next of course your boyfriend knows why he was arrested and what the violation is, obviously he is not wanting to tell you for some reason.
    He would have been told, and it would have been listed on the arrest warrant and paper work the PO filed out.

    How else can he ( and his attorney he needs to hire) could they prepare a defense.
