    Going through divorce with a young child
    I am separated from my husband of 5years, we have only been separated since late May but I have been seeing someone else since March. My husband and I have a 3 year old son together and right now he has him the majority of time because of where I live, there isn't a lot of room for me to have him all the time, plus I work in retail overnights so my hours are all over the place. My husband is wanting full custody of our son, and I want us to 50/50 or me have full custody. How good are my chances considering I was having an affair? But I don't use drugs or have criminal history and am hard worker. I also don't really know what to do or where to go from here. I also can not afford a lawyer or to file.

    An affair has little to do with child custody any longer in most courts, A 50/50 is reasonable and unless they can prove a reason it is not a good in court, it should be allowed.

    Why now does he have the child all the time and you are not sharing ?

    If you can not afford an attorney, best is for you and ex to agree on terms and file together.

    But if you can't afford an attorney and can not even file in court, there is nothing you really can do ? You may try legal aid society in your city
