    My husband wants to adopt my son or at least have rights to him
    My sonis 16 months old and is biological father has seen him on and off over his life and has never really been there and in April the court appointed him to start paying child support and he has paid but has not seen my son since then. The child support is the only help I have gotten with my son. My son calls my husband dad and does not know his biological dad as anyone other than aman that comes and sees him once every couple months. I have asked my sons biological father to sign his rights over and he said no. and I was wondering if there is any other way to get them taken away sinves he's not using them anyway. Or any way to get my husband some kind of rights or legal guardian ship to him?

    You can force a parent to support a child; you cannot force that parent to participate in the child's life.

    No, you cannot strip the father of his rights unless there are extreme circumstances (incarceration being one of them).

    No, your husband cannot adopt, get legal rights or legal guardianship without the consent of the child's father. What rights does he need? You are the custodial parent and the mother.

    You can always tell the father that if the child is adopted the father's obligation to pay support ends.

    Sometimes that causes people to sign the adoption papers.

    Your husband can not have any rights unless he can adopt, he can not adopt without the other bio parents permission.

    Also the child should know who his dad is, he does, even if every few months come around and does send his child support, so you should be telling him that this other man is ( at least also) a father.
