    Received a W2 and 1099 from same employer?
    I am hoping someone can shed some light on an unusal tax situation. My husband has been with the same company for 4 1/2 years. Each pay period he receives one paycheck from his employer. For the past 3 1/2 years, he has always received one W2 for his earnings. For some reason this year is different... he just received a W2 AND a 1099 from his employer for earnings reported on one paycheck by one company. How is it possible to receive a W2 AND a 1099 from the same employer for earnings reported on one paycheck/payroll? Is this legal? They are trying to say a portion of his job is now contract work and a portion is employee work... something which he was never notified of and has never happened in the past. His job did not change last year, why did the reporting? Does this make sense to anyone? Thank you in advance!

    That situation IS unusual, but NOT illegal.

    He needs to file Schedules C and SE to report the income and calculate and pay the self-employment tax.
