    Criminal Discharge
Ok so I was caught stealing from an employer (stupidest thing ever I know), it was theft under 5000, I'm 18 and the judge sentence went as follows: criminal discharge, 100 hourse community service, 1 year probation... what I want to know is if I apply at say Futreshop and they request a criminal background check will it show up? Because my lawyer said it wouldn't and I wanted to make sure before I applied.

If your lawyer said it won't, then it probably won't.

I would like to think that the lawyer may know better but, yeah I don't know now. Maybe you should just go and apply now and maybe it is not on there yet.

It is the term that judge used, normally it is the sentence is suspended pending completion of probation and community service, you appear back in court afterwards and then the charges are droped.

So if that is what the judge meant it will not show up if you finish all of your work.'

Normally all convictions will appear on criminal record

Ya see the lawyer said it would show up for the police... but not an employer... I guess I could go request a criminal record check and find out.

Hooly... 100 hrs?? Woow... Ok I got caught shoplifting this year.. and I never got a lawyer because I was able to handle it myself. (all you got to do is set a resolution meeting with the crown and tell him you are very sorry and it was out of stupidity, you are a student and don't want this to affect your employment opportunities.. yadda yadda yadda) and most likely he/she will feel bad and tell you to make a donation. Which the crown told me :) I made a $250 donation, and I was off. No criminal record no nothing, not even a lawyer :D

    Ps.. I'm 18 too

Mind you this was from an employer... on a whim and the amount was huge... I don't want to go into details but it wasn't me who did the stealing just sort of nudged it along so to say.
