    How can they go after my spouse for my debt? When it's mine
    Before I met my hubby I has acquired medical debt and was paying. Then, in Jan 2009 I was lay-off and was receiving Unemployment until Nov. of 2010. RRC decided to put all my medical debt in my hubbys name and in now going after him and threatening him. Don't get me wroing, I now I owe this money and I would like to pay this, but we are barely scraping by. He has 2 children who live with us 1/2 the time, so he pays child support for when he's over their moms and here. When I lost unem. We started to eat beans, potatoes and cornbread several times a week. We could not afford $35.00 a month for medical when we can barely keep our home and fed our family. I asked if I could try and scarp at least $ 5.00 and month and she said that was just enough and they are about to start legal proceeding again my husband! Sending stuff to his work, threatening garnishment! I asked her just take me to jail because all they would do would try to make another payment arrangement we can't make ( x tra fees too ) and then garnish HIS wages which is wholly and grossly unfair! Is there anything I can do? Please help, I am at my last straw and barely hanging on!!

    They can't garnish his wages without getting a judgement. They can't get a judgment without proving its his debt and I'm not sure how they can do that.

    Send them a letter stating that the debt is yours incurred prior to your marriage. That they are not to contact your husband any more and that all further correspondence be only in writing according the Fair Credit Reporting Act. If they do not comply you will take further action under that act.
