    How to get accounting from an estate from family member?
    My brother and I are currently listed on my deceased mother's will. I need to know what I can do to get an accounting from my brother of all the things that he paid for while my mother was still alive. After her death, we paid for the funeral, medical bills, preparing her house for sale (it needed to be cleaned out professionally). Since then, I cannot get my brother to give me an accurate accounting of what was spent. He will not cooperate. I feel that he has spent some of the money that was left to the two of us on his personal bills. What do I need to do? He will not give me any paperwork regarding this. We also need to transfer the property tile of her house into both our names. Where do I go to get any answers. I have a copy of her will which states that we are to divide all the assets equally. Please help!

    If you are in the USA the will and estate should go through probate court. Who was apointed executor of the estate?

    The only thing that my mother did was to give my brother a medical power of attorney. She was old fashioned and would not sign anything except for her will which has been recorded in Cook County, Chicago, Illinois. Outside of that, we were to divide all her assets (money market, savings and her home (he has the title), after we paid for cleaning up her house and funeral costs. These have been all taken care of, except I have no idea what moneies were left after he paid all her final bills. He will not begin the probate process, and without him, I cannot do anything. I do have a copy of her will. I need to know if I can do that process alone without all the other information that my brother has. I do not want to start a war with him, so I do not know how to do all this legally.

    That's a durable power of attorney and it died the moment mom passed. Call (312) 603-6441
    And ask to speak Jennifer Smith Assistant Chief Deputy or Clerk Jenna Pileggi and ask them the procedure that you should follow.

    This definitely needs to be looked at by an attorney so that he can tell you what options you have and how you should go about accomplishing what you are trying to do.
