    Hi,

I got the SSN in year 2010 and I have paid my tution fees in 2010 around 10000 USD. I got job in Dec 6th 2010 and continuing the job till today.

My employer send an w 2 from by running payroll of 64 hrs around 1440 $ and tax is dedcuted around 170 $ including state and fedral.

My question is can I claim my tutuion fees around 10000 $ and get more tax benefits i.e more that 170 $ which I have paid for the taxes. One of my friend claimed in tax returns and got more money than he was paid.

I assume that you know your parents aren't claiming you?
You can't get back more than you were paid; you can get back more than was deducted in federal tax by claiming the Earned Income Credit, which is based on income.

    Joy:

Actually, that is NOT true. The American Opportunity Credit has a $1,000 portion of the AOC credit that is refundable, which means you get $1,000 even if you have no tax obligation to offset.

    Anil:

What is your visa status? In order to claim ANY education credit, you MUST be a resident or citizen of the United States. If you are an international student on a F-1 or J-1 visa, then you are NOT eligible for the AOC or any other education credit or deduction.

Thanks, Atlanta. I was looking it up, had also asked about his status when I saw 'USD,' but somehow answered with my first reply.
