    Lease ending but gave only verbal notice
    My lease ends on April 10, 2011. According to the lease we needed to give 60 day written notice. Due to unusual circumstances we gave them over 60 day verbal notice and was told that was enough. The woman that has been with us the whole time told us that since we weren't 100% sure what we were doing they would put down that we were leaving but keep our place for the last one to rent out. She said that our end of giving the notice was complete. We went into the office to see what all needed to be done before we leave and the woman we spoke to is no longer in this apartments office so there is no record of us speaking to her.We talked to another person in the office at the apartment. They said we still had to give a 60 day notice from that day. We told him we are unable to pay so he suggested to just send it to collections. We have a new place to move into by the 10th so what do we do?

    Unfortunately, it is a he said/she said situation and without any written backup you are at a disadvantage. Can you contact the previous person you spoke to? Perhaps she will back you up. You should always give and get written confirmation.

    Hello s:

    In real estate matters, only WRITTEN documentation will be accepted as evidence.. A contract or letter written by the lady TODAY, even if you DO find her, won't be accepted as evidence.

    So, you technically DO owe the rent... However, if you offered, say, ONE months rent as a settlement, they might take the deal. You know, a bird in the hand thing... Make sure THAT one is in writing.
