I am trying to change my son's name to my biological name. I have called his bio.father and he is not accepting my calls. I am wanting him out of my son's life all togethr, he is not a good person now.He is back in the military basically prison from what I have been told. He does not help me with his son. My husband now is taking care of my son. And the bio. Father is not calling him does not sending me money for financial purposes, he is not willing to help in anyway, so please help me and tell me what I should do.

Does your current husband want to adopt ? If so, you make contact with ex and see if he will sign to allow the adoption.

If the bio father refuses to allow the name change it probably won't happen. But the only way would be to go to court and try to get a court to agree to the change.

Im surprised at this use of deadbeat here. If he is in prison then he has no way of doing the things your requesting. You can't even use that for a defense. Has he harmed the child in some way?

He is not in prison he went awol a few years ago in a time of war. When him and I have talked in the past he has told me that he is still the same rank he was when he left. No my husband does not what to adopt. I have been talking to several lawyers and they are willing to help me with this, the bio father is unfit which I can prove he was in a rehabilitation center for these things he is bipolar supposed to be taking his medicine but won't. We have been friends for 17 years and I thought when I was younger that he would always be there for me but now I have found out that he won't and that's fine by me. But my biggest concern is my son who will be 2 in 17 days, he has not done anything for my son since his birth.
