    Why do you want to do this?

    Seriously--you realize that the likelihood of involuntarily terminating someone else's parental rights is pretty close to nil unless you have SERIOUS proof that the other person is a DANGER to the child, right?

    My daughter is 17 and has refused to see or speak to her father for over 6 years due to him doing drugs and partying with minors the last time she was visiting. He has signed the affidavit to relinquish his rights and my daughter wants to change her name to either my maiden name of her step-dads name.

    So... is your husband going to adopt her?

    If he's signed the affadavit --did he sign this in a courtroom?--this isn't an involuntary relinquishment.

    Essentially, you NEED to get a lawyer. Then you NEED to go to court to have this done. However--a court generally isn't going to terminate parental rights unless it's to protect the child (the parent is an immediate danger to the child) or to clear the way for an adoption. That's it.

    Especially since she's 17. She has less than a year to go before he doesn't HAVE any rights, and she can change her name legally without his permission.
