OPT Taxes, which form to file ?
    Hi,

I'm an international student and I have been working in USA under OPT status. My employer has deducted my SSN & Medicare taxes and I understand that I'm exempted from the taxes during my OPT term.
    My question is
1.Am I considered a resident alien (I have been in the USA from 2008 and have more than 183 days in the USA)
    2.Should I file 1040 EZ/1040 NR?
3.Should I file form 843 to get refund before filling taxes or after? Is mail the only option or can I do it online?

I don't have any dependents and my way of income is just my salary.

Every one on F-1/OPT is exempt from residency for 5 years. You must file nonresident tax return and Form 8843. You do not pay SS and Medicare taxes. Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents

You will file nonresident tax return.
You will also ask your employer to refund you SS and Medicare taxes as you are exempt. If you are unable to get it from your employer, then file Form 843 with IRS. File after two months of mailing your tax return.
For professional help in such type of returns, you can contact AtlantaTaxExpert.
