    Non Resident Alen : L1 visa holder from India
    Non Resident Alen : L1 visa holder: I am an non resident alien and came to US on Dec 2010 and I have received one month salary in US $ 4750 and tax withheld was $ 200, please let me know what form I should file to get the tax withheld as refund, I am married and I have one son 3 yrs old. *** also let me know form to be filed and tax.

    You would need to file form 1040NR or 1040NR-EZ. Your filing status would be married filing separately, you cannot claim any dependents.

    Did you get W-2 for 2010?
    If you have income in 2010, file nonresident tax return Form 1040NR-EZ or 1040NR. Also claim moving expenses using Form 3903.
