    Lost.OPT to H1.Dual status or not?
    Hi,

    I tried to figure out how to file my tax by reading previous answers, but still kind of lost... Here is my situation:

    I came to US on 08-22-2004
    OPT until 11-03-2006
    H1B 11-03-2006

    I left US on 11-24-2006 and entered on 12-16-2006. Should I fill up 1040-EZ (first year choice of residency) ? Or 1040NR-EZ ? Or am I dual-status?

    Oh I forgot to mention :o I am single and
    Between 08-22-2004 and 01-14-2006, I was on F1 Visa
    01-14-2006 and 11-03-2006, I was using my OPT

    You need to file as a non-resident alien one last time, filing Form 1040NR or 1040NR-EZ.

    In 2007, you will file as a resident alien.
