    Can I change my mind after giving notice on a month to month rental?
    I gave a month's notice on my month to month rental 6 days ago. I offered to vacate earlier than a month if that would be helpful, and my landlord said he has someone in mind to rent it, and would refund me any days he rented it sooner than a month. Can I change my mind and stay? This is the 2nd time I have given notice and then changed my mind, but last time my landlord did not have a new tenant in mind.

    Legally, notice has to be in WRITING... If you didn't write it, of course, you can change your mind. Even if you DID write it, you can change your mind. I'd do that in writing too.

    And if wouldn't be fair either. This landlord has been quite tolerant and accommodating.
    You are free to ask, of course, sooner rather than later.

    I see I am not in agreement with excon.. I think a court could go either way on this, especially if you did give notice in writing or if the landlord sued you because he got sued by the new tenant.

    Hello again,

    I wasn't clear in my previous answer. I took the easy way out. She asked if she can change her mind, and I said yes. That's is true, of course, but what I didn't say was whether her action would be successful or whether it was a good idea. Certainly, the landlord may not be amenable to the change of heart this time, and very well might challenge her. Given that the notice wasn't in writing, I think the OP would WIN that challenge. But, that still doesn't mean I think it was a good idea. Plus, she may win this battle, yet lose the war. She IS a month to month tenant.

    So, I agree with me AND joy.

    The land lord can hold you to your notice, but it will be up to them, so if you wish to change your minds , you will have to ask their permission, but after a couple of changes of your mind, I am not sure they will want to
