    One of the small diamonds of my custom made engagement ring fell off yesterday
    The ring is only 6 months old. Is the jeweler responsible for replacing the loss?

    Hello p:

    If he was negligent in his installation, he'd be responsible... But, the burden of proof will be on you to PROVE it, and I don't see how you can.

    That would be the LEGAL case.. However, if you took the ring to him, he MIGHT replace it on his own.

    There IS another legal answer. If he guarantees his workmanship for longer than you've owned the ring, and you have it in WRITING, then he MIGHT be responsible. I'd look on my receipt for that information, or if you have a contract, look there.. I say MIGHT, because even if you have it in writing, after 6 months, I'll bet he'll say you knocked against something, and that's why it fell out.

    Given that the case boils down to 'he said, she said', as the plaintiff, you'd have the burden of proof. I don't know HOW you would prove HE was negligent..

    Now, maybe somebody will come along and move your thread to the legal board where somebody else might give you the benefit of THEIR legal expertise.
