    Buying a houses with family member
    I bought a house with my brother in virginia.My brother and I agreed that he and his wife wiil live in the house and because my job I will live in New York.I had been staying in the house only when I have my vacations.My brother and his wife are divorcing now.My brother has no problems with me staying staying in the house like I always do on my vacations but my still sister in law called the policy to take me out of my house when my brother was not at home(he has to travel some times because his job). The policy in virginia is telling me I don't have the right to stay in the house because I don't live there and if I tried to enter the house I can be arrested for trespassing. My name is in the house tittle and in the mortgage.When did I loose my ownership rights on the house?

    You're the owner of the house - on the title/deed AND the mortgage and the Police have ordered you out?

    I see no way this can happen other than some argument in connection with the divorce, an Order, something along those lines.

    Need to know more about the how/why of you being ordered out.

    This is NOT a Police matter unless there is a no trespass order, no contact order, something along those lines.

    She called the police and she said that I'm taking her out of the house when she still is married to my brother.The police officer told me if I don't live there,I don't have the right to stay there.There's not a court order that it prohibit me to enter my house.The police officer never asked me what happened in the house?what am I doing in there? I know what she said to the police officer because my nephew was closed to her when she called the police.I feel I was discriminated because she and the police officer are caucasian and I'm hispanic.

    I forgot to tell you I never tried or my intention was to take her out of the house.She lied to the police officer.

    Your evicting her ( which you can't at this point) or you staying there is not a police matter, Merely have a copy of your deed with you,

    Unless your sister is trying to claim they are renters, so get with your brother, draw up a written agreement that they may stay in the house, but you also live in the home or you retain the right to a room when you are in town.

    Again, the police over stepped any authority, and you need to report that officer to their captain or chief as they broke the law interfering with a civil matter

    Thank u for you comment.I knew the police officer was wrong but I decided not to do anything because I was with my son.He asked me if I was going to be arrested. He was worried about me. The police officer never asked me for a copy of my deed.He only said "you can't be here". My responded was;" I'm the owner". He said it doesn't matter, you don't live here.My still sister in law don't have any paper or proof that she is renting the house.
