    Need to break my lease
    I'm in month 7 of my one year lease. I need to break the lease because my husband just got custody of his 10 year old daughter because her mother has gone to jail... this was unexpected... and a shock. I have a 20 year old son that lives with me while he attends college... they cannot share a room. I thought offering my deposit and one months rent along with 60 days notice was suffient... no.. I was wrong. Can I plead this to a judge to get out of the rest of my lease so that my credit isn't damaged? Our attorney for the custody case tells us it is not appropriate and the judge will not like the fact the daughter has no bedroom.

    The judge will hold you to the terms of the lease you signed... its a legal contract.

    If you can't offer the landlord something that makes them happy to release you from it... you are going to be legally bound by the terms of it.

    There is no suffient notice that will let you out of it... not in your situation anyway. About the only time you can get out of a lease with no repercussions is an Active Duty serviceman being deployed overseas.

    And that works both ways... the landlord can't throw you out early because they found someone else that's willing to pay more than you.
