    I have garnishments and just got married.
    We just filed a joint tax return. Will the creditors take the refund even though he is the head of household? The tax forms were filled out in his name.

    They can attach any account your name is on. Joint or not. Assuming they have a writ of garnishment.

    And its best to pay it and get it behind you as soon as possible.

    Your husband may file an injured spouse claim to receive the portion of the tax return that is his. You can file thins after your refund has been offset, or with you taxes if you are expecting an offset. He can receive any portion of the refund that he earned. This generally takes 11 to 14 weeks.
