    No custody
    I have a 3 year old and the father and I don't live together but we go together and I want to ended it, can he go into her daycare and take her from there?

    OK I have 3 year old and she lives with me and there is no custody in place but she goes to daycare and is going to be starting school and I want to know if I spend her if he can go in and take her from there

    Absent any agreement to the contrary between you and the daycare provider, yes.

    Is the father on the birth certificate, has he proved paternity.

    But if he is on the birth certificate he has as much legal right to child as you do.

    Remember he could come here and ask the same question, hoping he will get custody or at least joint.

    So you will need to get to court and get custody and visitation agreements all settled.

    But you signed a paper saying he is.

    So, until a court rules otherwise, he is, in the eyes of the law, as much the father as you are the mother.
