    Can I sue for lost commission?
    I worked for a startup for three years and set up a lot of opportunity. Just as our product was coming to market (finally) they hired someone else to take over my accounts, including an entire team of individuals that I had recruited to help us in the sales channel. I was told by management that I was doing a great job, and that I had really impacted the company in a positive way. Then, out of nowhere I was "laid off" for what they claimed was poor performance. I and everyone associated with my performance was shocked. I still can't figure this one out, because I had been praised throughout for doing a superb job. I was never given a performance review, but was praised publicly by our entire leadership team in front of our entire company. Do I have any recourse?

    ANY question on law needs to include your general locale as laws vary by area.

    Whether you can sue for commissions depends on how your pay was structured. If you can prove you setup clients and these clients are now generating commissions for someone you may have a case.

    I would consult a labor attorney.

    If you EARNED your commission, then you can sue for it... If you only set up the potential for earning commissions, then you have no case..

    I would recommend reading over your contract or have an attorney read over your contract. If you have outstanding commission of accounts you closed while working for this start-up, you certainly should try recouping your commissions. If you had a pipeline of deals that haven't closed, than probably not. If you are really mad and you don't have a non compete (depending upon the state) take your accounts elsewhere.
