    Final Divorce Decree awarded me a car and debt that was in husband name
    I recently divorced and everything was taking from me out of 21 yrs of marriage. What was given to me in the final divorce decree was the car that I pay for out of my account into the account of my ex that has the car listed in his name. He waited to the car was paid down to $1,000.00 went and paid the loan off. Now he thinks that I should hand him the money back cause the bank didn't continue to take money from me cause this account was paid, he assumed the bank would take the money and put on his other vehicle that's listed there as well. Once he find out they wouldn't he wants to sue me. What grounds if any do I have. The loan was not in default... his credit was not messed up even though the payment was late that month and the last.

    WOW. Nothing but a car after 21 years of marriage..

    If the divorce decree says that you pay the remainder of the car loan, then you do owe, regardless to whom.

    At any rate - what provision did the divorce decree make for paying off the car? You were to pay it or he was to pay it? If YOU were to pay it you owe him the money. If HE was to pay it you don't owe him the money.

    If two payments were late his credit WAS messed up.

    He could perhaps get the bank to credit the payment toward the other car loan instead, but then you would still owe the money and have to pay it. So, in the long run it wouldn't make any difference.

    So pay him the money. You can, if you want, make the payments in installments as you otherwise would have.
