    EAD denied without biometric Notice!
    Hi,

    I applied for my EAD on oct 29th, 2007. Got receipt on Nov 2nd 2007. Was waiting for a biometric notice mail from USCIS, but I didn't get anything. But suddenly on Mar 03, 2008 I got denial notice from USCIS saying, since you have not appeared to local support center for a photograph, signature and fingerprint for document production on Nov 29th 2007, we deny your application. No appeal to this decision.But to be true , I didn't get any notice from them.

    What can I do now? Can I get a Infopass to speak about my case to the USCIS officials, will it work ? Then how can I create a motion to reopen or a motion to reconsider in my case. Your advice would be apperciated.

    Hi

    A very similar thing has happened in my case as well. I applied for EAD on Sep-16-2010 and got a receipt within 3-4 days. I got the notice for Biometric 10 days after the scheduled date hence as soon as we received it, we called at USCIS and requested for rescheduling the same. We used to check our status online regularly and this update was never there online as well. Surprisingly, we received a notice of denial on Dec-6-2010. And on top of it, after 2 days, on Dec-8-2010, we received a notice of rescheduling of Biometric for Jan-2011. I think, there is some big flaw in USCIS internal processes which leads to lots of harassment for the applicants due to no logical reason. Anyway, the only option which has been suggested to us by USCIS is to reapply rather than taking the 'motion' route and request for fees waiver. There may be a possibility that officer considers the genuinity in your case. Our other learning is that even if you receive the notice for Biometric a little late then rather than requesting for rescheduling, just visit the nearby center and request them to take your Biometric.. they are generally a bit flexible to consider genuine cases like this.
