    Claim depenedents on H4
    Hi ,Came to US in may2010. My family(wife and daughter) joined me in sept and went back in dec2010. Can I claim them as dependents. I have not filed for ITIN for them and my wife does not have SSN

    You will NOT claim your wife as a dependent; you will file JOINTLY with her, which is better because it DOUBLES the standard deduction to $11,400.

    But you WILL claim your daughter as a dependent.

    In both cases, you will need to submit Form W-7 to get them ITINs. Since your wife MUST sign her W-7 and the tax return, filing the return will take some time and effort, but the enhanced refund IS worth it.
