Hi I just had my twins and they are four months but some how I tried to file my daughter and it was rejected do to someone used her s.s number so how is it that someone can do a thing like that without her s.s card I thought that was against the law.

As long as they have the child's SSN, they do not need a card. With e-filing its easy. If you tried e-filing only to find out that someone had claimed your child, then you need to file manually still claiming your child and let the IRS sort it out.

Yes it is illegal to falsely claim a dependent. However, I don't know where you got the idea that you need the child's SS card to file. As I said, file manually and let the IRS sort it out.

If you are sure that you are the one who can claim the dependent, then file your tax return and claim the dependent. It you are unable to efile, then send paper return. IRS with then contact both of you and figure out who must amend the tax return and pay the tax due with interest and penalty.
