    Need help out of a sticky situation
    Hi and thanks in advance for any advice offere. I'm in a bad situation, living with a mentally and verbally abusive wife.

    I need to divorce my wife. I believe she is mentally unstable and getting worse although she is on multiple medications. She has PTSD and many physical problems as well which results in many trips to the ER. I actually left her a few weeks ago taking our son. This resulted in her having a meltdown and ending up being hospitalized in a mental clinic. I had to comeback as there was no one else to get her out. She told me that she could have had me arrested for kidnapping our son. Is this true? I was just trying to protect him and myself. I have been his caretaker for many year as I work from home and raised him while she was in the military for 4 years where I was a house husband. On top of that she is already divorce and had left 3 other children behind with her ex to be with me.

    I believe I can provide enough evidence to prove that I have been primary caretaker and that she is unstable. Do the courts look at it this way? Or do they tend to favor the wife no matter what when it comes to custody. I am very afraid of my wife and will not even broach the subject of divorce for fear of her going off the handle. I would have to do it behind her back. Just like when I had to leave without her knowing. She knows how to manipulate, lie and control. I just want my son and I to live in a non-mentally and verbally abusive house. He nor I deserve such treatment from her. I live in Florida so of course Florida law applies.

    So, bottom line...

    Could I go to jail for kidnapping our son even if it was to protect he and I?

    When I divorce will I loose my son or can I fight based upon her mental stability and poor health?

    Any advice on this would be very much appreciated. Thank you for your time.

    Next time it happens you might want to file right away and get a protective order. Was this all of the sudden or was she like this before you married?

    Hi,thanks for the reply. She has always been mentally unstable which I discovered not long after her moving in with me. I would have dumped here except she has no family or friends.. nowhere to go but the streets. Finally I had the chance to get away but she surprised me by getting pregnant on purpose. She definitely trapped me. I didn't marry her right away.. not until my son was 2 years old at which time she went into the military.. then I married her so I would be able to tag along and not lose my son. She's always had me believing that she would take him from me and I would never see him again so I've just kept on faking everything was OK. Now, I'm just done with her and the mental/verbal abuse. I want my son and I to be in a safe home without all the psycho drama.
