Question about accident
I was in an auto accident in March 1999 and sideswiped by another driver who swerved to avoid someone hitting her.
She was cited and I went through physical therapy and they had me sign paperwork (can't recall what it was) and sent me a check for around $5,000. In 2004 a CTA/Xrays for a stomach problem showed I had sclerosis starting but, I've had no problems until 2010. I had some CTA/Xrays for my heart done that shows degenerative disc changes in my spine in the same place that was messed up during the accident and I'm suffering a lot and having problems. Is there anything I can do? I read something about accelerated or aggravated damages but can't remember what it was. |

It depends on whether the paper you signed was a General (or, for that matter, Specific) Release. If you released the other party and/or insurance company from all future claims, you cannot file again. I would venture a guess that you signed a Release in exchange for $5,000. In the event you did not do you have a Physician who will state that your current problems are a direct result of the accident? You also have a problem with the Statute of Limitation. |
