    suspended-sentence
    My son has a 12 month suspended sentence, one of his conditions is not to contact his x partner,last week under the influence of drink he text her only to wish her happy new year,will he be sent to prison for it

    A one time Birthday wish I would doubt it unless the judge really has it out for him. Did the woman report him? If she reported him and if he said things to her he shouldn't have then his odds of going to jail go up.

    First she will have to report him to the police and to the court.

    Then if they few this as breaking the rules, they will issue a warrant for him and make him appear back before the court.

    *** I think I would leave out to the court the drunk part, will not really help his case, But again do't tell the court anything without talking to the attorney.l

    Next of course you did not tell us what crime the sentence was for, that makes some difference,

    But they may if she pushes it, change the sentence from suspended, and actually sentence him,

    Sounds like time for AA and go back to no contact

    Don't know what to say. Have him throw himself on the judges mercy maybe. What he did was illegal no matter why he did it but the judge may cut him some slack based on the contents and maybe the state of mind he was in.

    At this point nobody knows about this except the son and the girlfriend. Agree with FrChuck. IF he is reported and violated it could go several ways - serve the original sentence, serve original sentence plus additional time for breaking probation, back to jail, a lecture and back on probation.

    Has the "partner" reported the contact?
