    Custodial parent in Jail? - Texas
    Hi, I had posted on here before about my husband trying to get custody from his ex girlfriend. Today we heard that she might be in jail so I went to her myspace. She posted in her status that "Goin2jail but they can't keep me4ever ill break out if i have2the law can't hold me4ever im worse then charles manson 2 years tops"... We are waiting to see if we can find more information but I have two questions.

    1. If she is in jail how do we get the child and switch custody?

    2. If she is lying about this.. will that statement make her look unfit since she is lying about going to jail and being worse then charles manson?

    I mean come on charles manson! Who would want their children around that kind of person...

    She is certainly not doing her image or credibility any good.

    That is just one of the many things she posted. Like posting she was pregnant and buying the baby clothing when she was not pregnant. Or "Sleeping next to my son and my husband" Then admiting they are trying to have a child together. I do not think it is appropriate for a 1 year old to be sleeping in the bed with his mother, and her boyfriend.

    While a stupid Facebook post can be one of many things, it into itself will not prove anything by itself.

    You will have to file in court for a modification of custody to get custody changed, But if they can not watch the child, because they are in jail. No one else buy you would have rights to custody.

    Thanks Fr_Chuck! I just thought that with her saying she was worse then charles manson and everything the judge would think a minute before turning us down for custody.

    I think I posted I could sing better than Vanilla Ice. Remember people write silly things on Facebook, many of the pages are even pretend lives people live online.

    There are 10 year old kids with pages saying they are 25, ( so they can get on and play games and the such without parent approval)

    Talking trash, really is not proof of anything, except they talk trash. What and how they parent and the well being of the child is what the court wants to know

    That is true you can say anything and everyone online true or not. I was hoping there would be something with that though. :) now just to find out if she is in jail or not.

    Who would have gotten care of the child if she was arrested? I would contact family services where she lived and find out if the child was placed into foster care. Also check to see if she was actually arrested or convicted. If she was, then the father stands a very good chance of getting custody.

    She lives with her aunt, and her cousins who I have proof that do drugs. (pictures and concersations). I have been checking dallas country and fort worth to see if she is listed as an inmate. However, nothing so far. The only people I can think of who would take the child is... 1. her father who she hardly talks to. 2. her aunt who she lives with. 3. her boyfriend.

    If your husband has been declared the legal father and you find out she is in jail then take proof of his legal status and go pick up the child.

    Yes, there has been a court ordered DNA test showing that my husband is the father, and he has a order for vistiations even though she don't let us see him. Which is why we are trying to get custody now.
