    Query on claiming back taxes that will be paid on L1B short term - Atlanta
    Dear Atlanta Tax Expert, I have a query.

    1) I will be moving to Atlanta, Georgia, US on L1 visa for two months from my company which is joint headquartered in INDIA and the US. They would obviously deduct taxes like federal, state, ssn, medicare taxes etc from my salary. My question is: amongst the tax deducted in my salary, can I claim back any amount later given that I will be staying for less than 180 days. If so, what all can I claim back and what is the procedure? PS: I would be getting salary when I am in GA, US and since this is short term work permit, I would also be getting a 50% reimbursement on my stay and conveyance apart from the salary from my company.

    2) The refund if any will be given only when the tax for the year 2011 is filed in 2012 is it?

    3) Another question is: if I return back to US within the same year on work permit again, will it have any implications on the tax or the amount I claimed back?

    I am assuming the salary originates from the U.S. company since taxes will be withheld.

    Due to your short stay, you will file as a non-resident alien, filing Form 1040NR.

    Is the 50% reimbursement taxable compensation, or is it tax-free?
