    Dna test in court
    If you go to court for access and your not on the birth certificate it is said the baby is not mine do you need to get a DNA test and if so who pays for it

    You will have to file for your rights to visitation. Along with that you have to ask for a DNA test to prove you are the father. You will pay for the testing

    You went to court for visitation, but it was ruled that the child is not yours? On what basis was this ruling made? Generally, if there is a question about paternity, the court will order a paternity test. Who pays depends on the court ruling. ANY question on law needs to include your general locale as laws vary by area.

    No what I mean is that the mother of the child is claiming that the father is not the father so if we were to ask for a DNA test who would have to pay

    If the mother of a child is unstable and you have evidence through texts of this would the father be able to try for custordy and would he be granted this

    If you have had a child with your partner and he cheats on you and has a child with that women and we break up would you be able to restrict his access and stop him taking the child to the woman's house through court?

    First, please don't use the Comments feature for follow-up. Use the Answer options instead.

    Again, it depends on the court and local laws. Some courts will pay the cost, some will require the plaintiff to pay.

    The father has the right to try for custody regardless of the mothers stability. And simply having texts doesn't or may not prove anything.

    I've merged all your threads because they all appear to be related to the same issue. It would be better if you just give us a summary of the whole story rather than posting piecemeal questions.

    We've already answered the DNA question. Proving instability is not easy, but yes if you can it would help gain custody. Finally, a parent can take their child to visit anyone during their visitation time as long as that person doesn't represent a danger to the child.
