    THey will still be an illegal immigrant even if you were a citizen. Marriage doesn't bestow an illegal with anything. They still have to apply like everyone else.

    Personally having known what it takes, and seen too many others try it. I think you are dumb for thinking about it. In fact harboring an illegal is a crime here and might affect your visa making you have to return to your home country, where THEY won't be legal either..

    Your spouse will not be eligible to apply for a change of status to L-2. will need to return to home country and apply for the L-2 visa and the waiver. Please note, the waiver is not likely to be approved for a NIV.

    No, he is not eligible to change status, and to process from US consulate in his home country in case like this could be very difficult. Discuss this issue with your attorney before submit any document.
