It can be, but who exactly is asking for the prescribed list of medications? Is it a doctor, nurse, a relative, a husband, or whoever. Can you just explain more to get a proper answer.

Were you applying for a nursing license, do you have a nursing license and did you sign to allow them to do a background check

If you are under investigation it is completely legal.

How is that legal? That is a violation of my privacy. I am under an investigation which has nothing to do with prescription medications. How can just anyone go into my file and obtain that. What if I was on Retrovior or other AIDs related medications and I didn't want anyone to find out that I had the disease? What is I was a transvestite and taking hormones for men? You get discriminated against no matter what. This doesn't see fair that they can retrieve that "PI" from me.

Most likely you were under investigation for some infraction or applying for a nursing license. In the latter case, the records were either gotten with a subpoena or you signed something allow them to get information for the investigation.
If you are applying for a license, the application probably included permission.

Hello n:
It may not be... Certainly, you have a lawyer. He'll know what to do... But, if you're under investigation, and you have NO defense, then you're defenseless..

Whether they obtained the info legally or not is something you have to hash out once they rule on the investigation. Without knowing the details of that, I can't say what the result will be. But if a court case results, then you may be able to argue against it being used as evidence.

OK, the whole thing is messed up, but they directed some remarks of me being a drug addict and telling the truth. I am not a drug addict! I have a long history of illnesses on being cancer (hodgekins disease) I have a high tolerance to medications

Since I am not a nurse I can not tell you about that application, but on my Insurance License, only Real Estate License, and where I work in the medical friend, In the paper work, all of the accreditation groups and my employers all have rights to run all sorts of background checks, including medical records, credit checks and criminal history, plus other consumer reports ( no idea what they are)
But I know at least in all of the medicial work I do, they not only can, but they are reqired to do a background search on me every year to be sure something new has not showed up
If you are under investigation, they can use that same authority to check almost any record they want.
