    Does a 60 day notice to vacate have to be to the day in Georgia?
    Does a 60day notice have to be to the day in the state of Georgia. The problem is that my lease is up jan 27 2011 I turn in a 60notice in writing on dec6 2010 my leasing office states I have to stay till feb 4 2011 and pay additional fees. My question is if I move out on the 27 of jan can legal action be taken against me and what might they be

    If your lease actually ends on Jan 27, you don't have to give notice at all. The landlord has to offer you a new lease. If your lease automatically renews on Jan 27 (which this sounds like?), and stipulates 60 days notice, then you owe for all 60 days, whether you move out or not. So you owe for 7 days.

    I would look at your lease, my leases say that they automatically renew UNLESS I receive notice prior to the 30 days of the lease renewing... It would go by the date on the lease that you signed not the day of your 60 day notice given. If you are there past the end of the lease , into the next month you may be required to pay for the entire month. I would talk to the landlord and see if you can pay a pro rated amount for the number of days you would be there... and I would be very willing to let them show the house so that they can get it re-rented asap...

    You would owe rent until the end of the notice period, in this case February 4th. Is this 60 day requirement the statutory notice period or is it provided for in the lease? It could also be that, because you failed to give timely notice on or before November 28th, you would owe until February 27th, depending on the terms of the lease. In other words, I don't know that you are entitled to pro-rate a month.
