    Roommates rights in virginia?
My roommate and I agreed to not let her boyfriend move in right away since she hadn't seen him or dated him in 5 yrs. They were mostly communicating by phone and computer since he lived in CA and we in VA. One night she informs me she told him he could move in and that he was already on his way. His presence here has caused great friction and increasing stress. I told her he had to leave and they both say I have no legal right to make him leave since he gave me 150.00 in cash for his expenses which have already exceeded that. Are they right?

    Hello l:

Yes, no and maybe... The maybe comes from whether you are his landlord or whether you're his roommate. I think you're his landlord. If you are, you can evict him by first giving him a 30 day written notice, and if he ignores it, you can evict him. So, they're NOT right.

The question is who is on the lease. If you both are on the lease, you both would need to agree to evict him.

Agreed, who is the renter from the owner of the apartment ( or house) if you are the renter and the other person then pays you and basically sub rents then you have the entire say, but would have to evict both if the one does not agree.

The problem is if you both are renting or both on the lease, if they are a renter equal to you, they may have this person there is they want to, and there is nothing you cando

I am the only person on the lease. At best they can be described as occupants/subrenters. Now she has threatened me twice in the past two days, should I get the police involved?

    Hello again, lost:

If you were to get a restraining order against them, they would have to leave IMMEDIATELY.

If you can document the threats, then that would be a quicker way to get them out.
