    Can my husband be ordered to pay child support for me if I am not working?
    Here is my situation.

    I have a total of 5 children. My oldest that is 6 1/2 is living with her grandparents (her choice by the way, and they have temporary custody that is just notarized not court mandated) and they don't have much for an income. Because their income is so little and my father is on SSI they have to depend on some public assistance for food, housing and medical. Here in the state of FL, the person filing for any public assistance is mandated to file with Child Support Enforcement for support from the parent(s) the child is not living with. I am re-married, and no longer in contact with my child's biological father (I have a restraining order on him and he is unable to be found), so I have been summoned to go to court for child support. Not a big deal (I do help my parents out with money). My question is, since I am not working and the only income in my house is from my husband and I am also getting some assistance for my kids, will my husbands income be counted as my form of income? Also will he have to end paying the support for a child that isn't his? I am scheduled to go to court February 11th, do I bring his pay stubs? Any advice would greatly be appreciated.

    No they don't have temp custody, notorized is just an official witness, it has no legal standing. So unless the court approved or ordered it, that document is not worth the paper it is printed on.

    But your husband is not liable for YOUR child support, but you are. So if you don't pay, they can take your drivers license or put you in jail. So you need to go back and get it lowered to the min amount possible. But you still have to pay that amount or suffer the penalties, So I would guess to keep you out of jail, he would pay your support
