    Is Changing Venue needed?
    I was divorced in Florida and have had one modification for child custody in the Florida Courts in 2009 in order to move further North in the state I resided in with the minor children. I live in the state of Georgia and I am the primary custodial parent. There are 4 children involved and we have lived in the state of Georgia for 5 years. My child support is paid to me through him and most of the time it is late. He also only visits with 3 of the four children. Can I have the children's support my ex husband pays to me modified to reflect Georgia Child-support guidelines and have it paid directly to me through the state of Georgia or would I need to request a change of venue? I would also like to modify the child visitation for the child he refuses to spend time with but I just would like to try to have things handled in the state the children and I resided in. He is still in Florida.

    If the original divorce was in FL and one parent still remains in that jurisdiction, then that court will retain jurisdiction. You can try to apply for a change in venue, but it probably won't be granted.

    Unless he agrees to the transfer ( and why should he ?) it is doubtful the court will allow the transfer.

    He wouldn't... He doesn't agree to anything and sadly most of the things he does hurts the kids.

    Yes, unless he moves from FL they maintain jurisdiction.
